Rental terms

1. Eligibility and Licensing
The Renter must be at least 18 years of age and possess a valid motorcycle driving license legally accepted in Timor-Leste (either a national license from their home country accompanied by a valid International Driving Permit, or a valid Timor-Leste driving license). The Renter must present the original physical documents and a valid passport or national ID at the time of pickup.
2. Vehicle Use and Road Restrictions
The motorcycle is provided solely for personal transportation. The Renter acknowledges that driving in Timor-Leste is on the left side of the road and agrees to adhere strictly to all local traffic laws. Unless an off-road specific motorcycle is rented, travel is restricted to paved and well-maintained unpaved roads. Riding on beaches, through deep rivers, or on extreme off-road trails is prohibited. Crossing international borders (e.g., into Indonesia) is strictly forbidden under this agreement.
3. Safety and Mandatory Helmet Law
In strict accordance with Timor-Leste law, the Renter and any passenger must wear securely fastened, safety-approved motorcycle helmets at all times while the vehicle is in operation. The Renter assumes absolute liability for any police fines, personal injuries, or legal actions resulting from the failure to wear a helmet.
4. Fuel Policy
The motorcycle is provided with a specific fuel level (noted at checkout) and must be returned with the exact same amount of fuel. If the motorcycle is returned with less fuel than supplied, the Renter will be charged a refueling fee in USD, which includes the cost of the missing fuel plus an administrative service charge.
5. Rental Period and Late Returns
Rental rates are calculated on a strict 24-hour basis. The motorcycle must be returned to the agreed location by the date and time specified at checkout. Late returns exceeding a one-hour grace period will incur additional charges, up to and including a full additional day's rental rate, unless a lease extension has been approved in writing by the Merchant in advance.
6. Damage, Loss, and Security Deposit
A security deposit (payable in USD cash or via authorized credit card hold) is mandatory at the time of pickup. The Renter is entirely responsible for any loss, theft, or damage to the motorcycle, its parts, and provided accessories (including helmets and keys) during the rental period. The security deposit will be applied directly against any damages or outstanding fees. If the cost of damages exceeds the deposit, the Renter remains fully liable for the remaining balance up to the total replacement cost of the vehicle.
7. Accidents, Breakdowns, and Repairs
In the event of a mechanical failure, the Renter must contact the Merchant immediately. The Renter is strictly prohibited from authorizing, performing, or commissioning any mechanical repairs without the Merchant's explicit prior consent. In the event of an accident, the Renter must immediately notify the local police (PNTL) to secure an official report, notify the Merchant, and must not abandon the vehicle unless necessary for immediate medical safety.
8. Traffic Fines and Vehicle Confiscation
The Renter is solely and personally responsible for all traffic fines, parking tickets, and police penalties incurred during the rental period. If the motorcycle is impounded or confiscated by Timorese authorities due to the Renter's negligence, traffic violations, or illegal activities, the Renter shall remain liable for the standard daily rental rate for the entire duration the vehicle is impounded, in addition to all recovery costs, storage fees, and associated legal expenses.
9. Insurance and Personal Liability
The rental includes basic third-party liability insurance as required by Timor-Leste regulations, providing limited coverage for damages caused to third-party property. It does not cover personal injuries to the Renter, injuries to the passenger, or physical damage to the rented motorcycle itself. The Renter acknowledges the inherent risks of operating a motorcycle in Timor-Leste and assumes all responsibility for personal injury or death. The Merchant accepts no liability for medical costs, and the Renter is strongly advised to secure comprehensive personal travel and medical insurance that explicitly covers motorcycle operation.
10. Unauthorized Drivers
The motorcycle may only be operated by the individual(s) explicitly named in the booking and verified by the Merchant. Subleasing, renting, or allowing any unauthorized person to drive the motorcycle is a material breach of this agreement, resulting in the immediate termination of the rental without refund, forfeiture of the security deposit, and the voiding of all liability protections.
